{"id":76,"date":"2020-03-29T13:36:54","date_gmt":"2020-03-29T12:36:54","guid":{"rendered":"http:\/\/intercala.com\/blog-en\/?p=76"},"modified":"2020-03-29T13:36:54","modified_gmt":"2020-03-29T12:36:54","slug":"what-a-community-should-not-do-to-save-money","status":"publish","type":"post","link":"https:\/\/intercala.com\/blog-en\/2020\/03\/29\/what-a-community-should-not-do-to-save-money\/","title":{"rendered":"WHAT A COMMUNITY SHOULD NOT DO TO SAVE MONEY"},"content":{"rendered":"\n<p>Nowadays, all the communities are trying to\nsave money in all the works and services that are necessary to be done.\nSometimes they are just choosing among different possibilities or different\ncompanies in order to get the cheapest and better one, (which is completely\nfair and legal), but it is quite frequently to see how some communities\ndirectly save money in an illegal way.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; In\nthis article we are going to focus in the problem with the people working for a\ncommunity and, unfortunately, there are many communities paying a salary to\ngardeners, cleaners, and other workers without a proper contract and without\npaying the social security, which might generate huge problems to the community.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Should\nthe worker has an accident, the community will be the one to pay for the\ncompensation, what might be extremely expensive because the social security\nwill not cover anything and the community will have to be the one to pay for\nthe time he is not working; for any possible physical damage the worker might have\nsuffered, or even for the compensation to his relatives supposing he dies. <\/p>\n\n\n\n<p>In addition to these possible\ncompensations in case of accidents, the community will be fined by the Government\nin case there is someone working for the community without social security. <\/p>\n\n\n\n<p>The problem could be even worse if\nthe person working in the community is a foreigner from a non EU country,\nbecause in some cases this kind of illegal work on behalf of the community\nmight even be considered a criminal offence under the Art. 312.2 of the\nCriminal Law of Spain, so the president, the administrator, or whoever has been\ninvolved in this kind of illegal agreement taken with the worker might face a\nsentence to prison from 2 to five years. <\/p>\n\n\n\n<p>Even when the worker is Spanish or\nfrom an EU Country, the community could be involved in a criminal offence when\nthe workers are not doing the work with all the legal measures to avoid\naccidents according to the rules approved by the Spanish Government ( \u201cPrevencion\nRiesgos Laborales\u201d) as it is establishes in the Art. 316 of the Criminal Law of\nSpain.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; I\nhave seen that many presidents, administrators or other officers of the\ncommunity are very happy when they reduce the amount of the quotas saving money\nin any of the previous illegal way, but they are not aware the risks they are\ntaking. <\/p>\n\n\n\n<p>It is also surprising that many of\nthe owners of these communities tend to be very proud of their presidents or\nadministrators when they save a lot of money in works and services, and they\nnever question if everything has been made legally and there is no risk to pay a\ncompensation to the worker or his family or no risk to pay a fine. In fact many\npeople do not want to be aware that in case the workers are not legally contracted,\nthe community would be the one responsible, so all the owners will have to pay,\nwithout prejudice of the direct responsibility of the president, administrator,\nor the ones who took the illegal decision.&nbsp;\n\n\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &nbsp;Be very aware about the situation of the\nworkers in your community to avoid unpleasant and very expensive surprises, and\nbe properly advised by a legal and registered administrator about what to do in\nfuture.\n\n\n\n<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Nowadays, all the communities are trying to save money in all the works and services that are necessary to be done.
